CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2012 - 47 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 131 <br />OF THE ADMINISTRATIVE CODE ENTITLED "MAYOR" IN ORDER TO <br />PROVIDE FOR THE ESTABLISHMENT OF A DIVISION OF MAYOR'S <br />COURT, AND DECLARING AN EMERGENCY. <br />WHEREAS, on May 4, 2010, the electors of the City of North Olmsted approved Issue <br />34 to amend the Charter of the City of North Olmsted, whereby all departments and divisions <br />there under, with the exception of the Department of Law and the Department of Finance, are to <br />be established by the Council via ordinance; and <br />WHEREAS, this Council via Ordinances 2010-62, 2010-106 and 201-152 created a new <br />and revised Chapter 131, together with new and revised Organizational Charts, to re-organize the <br />Office of Mayor and the divisions therein; and <br />WHEREAS, Mayor Kennedy by virtue of Charter Article III, §5(c) is provided with the <br />following authority: "The Mayor shall have all the judicial powers granted by this Charter, the <br />ordinances of the City, and the general laws of the State of Ohio"; and <br />WHEREAS, R.C. § 1905.01 et seq. provides for the authority of Mayors to establish and <br />operate a Mayor's Court within the State of Ohio; and <br />WHEREAS, Mayor Kennedy by virtue of Executive 2012-1 has created the Mayor's <br />Court for the City of North Olmsted; and <br />WHEREAS, consistent with the action of the Mayor, it is the desire of this Council to <br />memorialize and recognize the Mayor's Court by virtue of amending Chapter 131 of the <br />Administrative Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 131 "Mayor," which presently reads in its entirety as set <br />forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully <br />rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in <br />Exhibit B, which is likewise attached to this Ordinance and likewise incorparated by reference as <br />if fully rewritten herein. <br />SECTION 2: That any ordinance, cr part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification.
