CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2012 - 52 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO A <br />CONTRACT WITH ROETZEL CONSTRUCTION, INC. AS AN <br />EMERGENCY EXCEPTION TO PUBLIC BIDDING TO PROVIDE <br />CONSTRUCTION SERVICES TO THE CITY FOR WINDOW <br />REPLACEMENT, ALL AS DETAILED IN THE NORT$ OLMSTED <br />FACILITIES ENERGY CONSERVATION PROJECT SPECIFICATIONS, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, in 2011, the City received a grant through NOPEC's Powering Our <br />Communities Program to install new energy efficient HVAC systems, windows, and interior and <br />exterior lighting at the North Olmsted City Hall, Senior Center and Community Cabin; and <br />WHEREAS, using technical specifications prepared by URS Corporation, projects were <br />bid in November 2011, involving separate bid packages for HVAC, lighting, and windows; and <br />WHEREAS, the HVAC and lighting projects were bid, contracts were awarded and the <br />projects executed; and <br />WHEREAS, the windows project received only one bid, which was deemed to be <br />unresponsive; and <br />WHEREAS, despite technical specification and scope of work amendments, the windows <br />project was rebid in April 2012, and no bids were submitted; and <br />WHEREAS, the original project deadline was December 31, 2011, and it has been <br />extended to June 30, 2012; and <br />WHEREAS, if no contract is awarded, nearly $80,000.00 in grant funds will be forfeited <br />and the project will be cancelled; and <br />WHEREAS, Charter Art. VIII, §6 provides for an exception to public bidding for real and <br />present emergencies in order to immediately provide for the public health, safety and welfare; <br />and <br />WHEREAS, a real and present emergency exists in that significant funding is available to <br />the City to replace failing, thirty year old windows which needlessly waste untold taxpayer <br />dollars through energy loss; and <br />WHEREAS, the public health, safety and welfare will be greatly benefitted through <br />saving taxpayer dollars which can be put to better use other than paying for energy loss; and
