CITY OF NORTH OLMSTED ORDINANCE NO. 2012 -57 BY: Mayor Kennedy AN ORDINANCE AMENDING ORDINANCE NO. 2006-94 TO AMEND THE PRICE RANGES AND TO OTHERWISE RESTATE THE PROGRAM FEES FOR USE OF PARK AND RECREATION FACILITIES, AND DECLARING AN EMERGENCY. AS AMENDED. WHEREAS, by virtue of Ordinance No. 2006-94 (which repealed and replaced Ordinance No. 2004-85) Council has established rates and fees for the use of the facilities and programs of the Division of Parks and Recreation; and WHEREAS, the Recreation Commissioner and the Mayor, in the course of administering the recreation facilities, determined and recommended that amendment and restructuring of the price ranges are necessary for the effective operation of the Recreation Center and Parks; and WHEREAS, the Recreatiori Commissioner has, by and through the Mayor, requested amendment of the price ranges and fee structure at the Recreation Center; and WHEREAS, it is the desire of this Council, in accordance with and pursuant to the foregoing request and recommendation, to adopt changes in the price structure for services at the Recreation Center and Parks; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA CDU?VTY, AND STATE OF OHIO: SECTION 1: That the price ranges and fee structures as established in Ordinance No. 2006-94, which presently read in entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance and likewise incorporated by reference as if fully rewritten herein. That this Ordinance is herebv declared to be an emergency measure immediately necessary for the preservation of the nublic health, safetv and welfare, and further for the reason that it is necessarv that this Ordinance go into effect immediately in order to permit the Recreation Center to publish and implement the new fee structure in time for the Winter season; and further nrovided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and annroval bv the Mayor.
