CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2012 - 61 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO AN <br />AGREEMENT WITH THE PINE RIDGE HOMEOWNERS <br />ASSOCIATIONAND JOSEPH COLEMAN GRANTING A LICENSE TO <br />CONSTRUCT A PERMANENT PINE RIDGE DEVELOPMENT SIGN <br />IN THE PUBLIC RIGHT OF WA YA T4387DOVER CENTER ROAD IN <br />THE CITY OF NORTH OLMSTED. <br />WHEREAS, the Pine Ridge Homeowners Association, for purposes of increased visibility <br />and safety, proposes to construct a permanent Pine Ridge Homeowners Association sign on the <br />treelawn within the public right of way at property located 4387 Dover Center Road, North Olmsted., <br />Ohio and owned by Joseph Coleman; and <br />WHEREAS, to facilitate the project, the City of North Olmsted has agreed to grant to Joseph <br />Coleman and the Pine Ridge Homeowners Association a license permitting it to access and utilize <br />the public right of way for such purpose; and <br />WHEREAS, Joseph and Florence Coleman have consented to the placement of such sign at <br />such location; and <br />WHEREAS, it is the recommendation of the Director of Planning and Development that said <br />License Agreement be entered into; <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayar to enter into a <br />License Agreement with Joseph Coleman and the Pine Ridge Homeowners Association in order to <br />allow construction of a development sign at 4387 Dover Center Road in the City of North Olmsted. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF 7HE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a License <br />Agreement with Mr. and Mrs. Joseph Coleman and the Pine Ridge Homeowners Association. The <br />License Agreement shall be in form and substance substantially similar to the attached License <br />Agreement, marked as Exhibit A, and attached hereto, with only such changes to be hereinafter made <br />in said contract as are not substantially adverse to the City and which are approved by the Director of <br />Law. The character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the <br />Agreement by the Director of Law. <br />SECTION 2: That this Resolution shall take effect and be in force from and after the earliest <br />date provided for by law.
