CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2012 - 71 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR, ON BEHALF OF <br />THE CITY OF NORTH OLMSTED, TO ENTER INTO AN <br />AGREEMENT WITH ST. BRENDAN PARISH GRANTING THE <br />LATTER PERMISSION TO PLACE BANNERS ON POLES <br />LOCATED IN THE CITY RIGHT-OF-WAY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, it is the desire of St. Brendan Parish to place banners on designated <br />Cleveland Electric Illuminating Company ("CEI") poles located in the City right-of-way <br />at existing City banner locations in order to highlight its location within the community; <br />and <br />WHEREAS, the Mayor and the Director of Planning and Development support <br />the proposal; and <br />WHEREAS, it is the desire therefore of this Council to accordingly authorize the <br />Mayor to enter into an Agreement with St. Brendan's Parish granting it permission to <br />place banners on CEI poles in the right-of-way at locations on Lorain Road between <br />Clague Road and David Drive; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he <br />is hereby authorized to enter into an Agreement with St. Brendan Parish permitting the <br />latter to place banners on designated CEI poles located in the City right-of-way at <br />locations on Lorain Road between Clague Road and David Drive. Said Agreement shall <br />be substantially in the form as the Agreement attached hereto as Exhibit A, with only <br />such changes therein as are not substantially adverse to the City and which are approved <br />by the Mayor and the Director of Law. The character of any such changes as not being <br />substantially adverse to the City shall be evidenced conclusively by the execution of the <br />Agreement by the Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the further reason that the Agreement must go into effect immediately in <br />order to permit placement before the October 31, 2012 removal date, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor.
