w1 CITY OF NORi H OLMSTED RESOLUTION NO. 2012 - 74 By: Mayor Kennedy A RESOLUTION APPROVING THE SOLID WASTE MANAGEMENT PLAN AS ADOPTED BY THE CUYAHOGA COUNTY SOLID WASTE MANAGEMENT BOARD, AND DECLARING AN EMERGENCY WHEREAS, in accordance with Ohio Revised Code ("O.R.C.") §3734.53 to 3734.55, the Cuyahoga County Solid Waste Management District ("District") has prepared and adopted a final draft of its Solid Waste Management Plan Update for 2013 to 2028 ("Plan Update"); and WHEREAS, the City of North Olmsted is located within the jurisdiction of the District and the District has forwarded a copy of the Plan Update for administrative review and legislative ratification, a copy of which is on file; and WHEREAS, in accordance with O.R.C. §3734.53 to 3734.55, the City must decide by November 17, 2012, to either approve or disapprove the Plan Update; and WHEREAS, the Director of Public Safety/Service has reviewed the Plan Update and recommends that the City approve in accordance with statutory obligations; and WHEREAS, it is the desire of this Council, in order to provide for the public health, safety and general welfare o:' the residents of the City of North Olmsted, to approve the Plan Update and to notify the District in accordance with law. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Cit,y of North Olmsted, Ohio, does hereby approve the Cuyahoga County Solid Waste Management Plan Update (2013-2028). SECTION 2: That the Clerk of Council is hereby directed to send the District a certified copy of this Resolution, specifically addressed to Diane T. Bickett, Executive Director , CCSWMD, 4750 East 1315Y St., Garfield Heights, OH 44105. SECTION 3: That it is found and determined that all formal actions of this Council with regard to this Resolution were adopted in open, public meetings in compliance with law. SECTION 4: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that the District's Plan Update (20130-2028) must be approved or disapproved by the City prior to November 17, 2012, in order to meet statutory deadlines; and further provided it receives tne affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
