CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2012 -76 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 927 <br />OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE <br />ENTITLED "STORM WATER MANAGEMENT AND URBAN POLLUTION <br />ABATEMENT SYSTEMS" IN ORDER TO IMPLEMENT NEW STANDARDS <br />FOR STORM WATER COLLECTION AND MANAGEMENT WITHIN THE <br />CITY OF NORTH OLMSTED, AS AMENDED. <br />WHEREAS, the City of North Olmsted is subject to and affected by regulations of the <br />Ohio Environmental Protection Agency (OEPA) including the Municipal Separate Storm Sewer <br />System Permit (MS4); and <br />WHEREAS, changes in the OEPA's permit conditions recommend that local <br />communities amend and update ordinances in order to incorporate standards adopted by the <br />OEPA in 2011; and <br />WHEREAS, this Council finds and determines that storm water management and <br />pollution control is vital to the public general health, safety and welfare of the community; and <br />WHEREAS, this Council further finds and determines that each unique storm water <br />management and / or urban pollution abatement system installed in the City of North Olmsted is <br />an integral part of larger citywide initiative to manage storm water and abate urban pollution; <br />and <br />WHEREAS, it is the recommendation of the Administration that the City amend its storm <br />water ordinances consistent with OEPA requirements; and <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration, to amend and re-establish Chapter 927 for Storm Water Management and Urban <br />Sediment Pollution Abatement Systems. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 927 "Storm Water Management and Urban Sediment <br />Pollution Abatement Systems" which presently reads in its entirety as set forth in Exhibit A, <br />which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, <br />shall be amended and, as amended, shall read in its entirety as such amendments are displayed by <br />boldface and as stricken in Exhibit A.
