CITY OF NORTH OLMSTED ORDINANCE NO. 2012 - 77 BY: Mayor Kennedy AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 928 OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE ENTITLED "POST CONSTRUCTION STORM MANAGEMENT REGULATIONS" IN ORDER TO IMPLEMENT NEW STANDARDS FOR STORM WATER COLLECTION AND MANAGEMENT WITHIN THE CITY OF NORTH OLMSTED. WHEREAS, the City of North Olmsted is subject to and affected by regulations of the Ohio Environmental Protection Agency (OEPA) including the Municipal Separate Storm Sewer System Permit (MS4); and WHEREAS, changes in the OEPA's permit conditions recommend that local communities amend and update ordinances in order to incorporate standards adopted by the OEPA in 2011; and WHEREAS, this Council finds and determines that storm water management is vital to the public general health, safety and welfare of the community; and WHEREAS, this Council further finds and determines that each unique storm water management system installed in the City of North Olmsted is an integral part of lai•ger citywide system to manage storm water; and WHEREAS, it is the recomm.endation of the Administration that the City amend its storm water ardinances consistent with OEPA requirements; and WHEREAS, it is the desire of this Council, consistent with the recommendations of the Administration, ta amend and re-establish Chapter 928 for Post Construction Storm Management Regulations. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Chapter 92$ "Post Construction Storm Water Management Regulations" which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as such amendments are displayed by boldface and as stricken in Exhibit A.
