CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2012 - 87 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR, ON BEHALF OF THE <br />CITY OF NORTH OLMSTED, TO ENTER INTO AN AGREEMENT WITH <br />THE CITY OF BEDFORD HEIGHTS TO PROVIDE JAIL FACILITIES FOR <br />MISDEMEANANT PRISONERS, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted, by and through the North Olmsted Police <br />Department (NOPD), upon the lawful arrest and detention of criminal suspects and, upon the <br />conviction and judicial order to commit such offenders to serve time in jail facilities, must <br />facilitate such incarceration in accordance with law; and <br />WHEREAS, the jail located at the NOPD are certified by the State of Ohio as a five day <br />holding facility and are not sufficient to house prisoners subject to judicial commitments in <br />excess thereof; and <br />WHEREAS, Cuyahoga County jail facilities, as operated by the Cuyahoga County <br />Sheriff, are often overcrowded and unavailable to house misdemeanants convicted under State <br />law and subject to jail commitments of more than five and less than thirty days; and <br />WHEREAS, the City of Bedford Heights owns and operates a full service, minimum <br />security jail which is certified by the State of Ohio to house misdemeanant prisoners and as such <br />is qualified to accept prisoner commitments from the City of North Olmsted; and <br />WHEREAS, this Council desires to enter into an Agreement with the City of Bedford <br />Heights to provide jail facilities in accordance with State law. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into an Agreement <br />with the City of Bedford Heights to provide jail facilities for misdemeanant prisoners, a copy of <br />which is attached hereto as Exhibit "A" and incorporated herein by reference, which is in all <br />respects hereby approved, subject to any changes as may be required by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately to accommodate <br />jail commitments issued by judicial authorities upon misdemeanor convictions; <br />and further provided it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor.
