CITY OF NORTH OLMSTED ORDINANCE NO. 2012 - 127 By: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE ONE RESCUE SQUAD FIRE APPARATUS FOR THE NORTH OLMSTED FIRE DEPARTMENT THROUGH THE STATE PURCHASE PROGRAM; FURTHER AUTHORIZING THE MAYOR TO EXECUTE NECESSARY CONTRACT DOCUMENTS; AND DECLARING AN EMERGENCY. WHEREAS, the Mayor has recommended that the City of North Olmsted replace a second rescue squad apparatus deployed by its Fire Department due to its age and mileage; and WHEREAS, the replacement of this rescue squad apparatus will protect the health, safety and general welfare of North Olmsted residents and other citizens by supplying the Fire Department with additional new and better apparatus equipment to insure the continued safety of citizens and fire fighters during emergency responses; and WHEREAS, Council has, by separate legislation, addressed the necessary appropriations and / or borrowing for this purchase, which is exempt from public bidding through the State Purchasing Program; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase the subject rescue squad fire apparatus through the State Purchase Program, as a permitted exception to the competitive bidding procedure that otherwise would be required for such expenditure, and to further authorize the Mayor to execute any necessary contract documents. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to purchase through the State Purchasing Program, which was established by O.R.C. Section 125.04 and which the City is authorized to participate in pursuant to Charter, one (1) new rescue squad fire apparatus consisting of the make and model, and containing such equipment, as is described in the specifications on file in the Fire Department. If necessary to effectuate any such purchase through the State Purchasing Program, the Mayor is hereby authorized to execute any contract and/or other appropriate documents required by the authorized vendor(s) or the State of Ohio. Any such contract(s) executed by the Mayor shall be in a form and substance consistent with the provisions of this Ordinance and approved by the Director of Law. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is necessary that this legislation go into effect immediately in order to lock
