WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a contract <br />with KMU Trucking and Excavating, Inc. for sanitary system improvements in the area of 6355 <br />and 6369 Barton Road, as set forth in specifications on file with the Director of Public Service. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: The conditions within the sanitary sewer collection system in the area of <br />6355 and 6369 Barton Road, as detailed herein, are a current and present emergency, requiring <br />immediate action as an exception to public bidding as set forth in Charter Art. VIII, §6. in order <br />to preserve the public health, safety and welfare. <br />SECTION 2: The Mayor be and is hereby authorized to enter into a contract and execute <br />same on behalf of the City of North Olmsted with KMU Trucking and Excavating, Inc. in the <br />amount of $47,734.00. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that the City <br />may expedite the process before spring rains result in flooding and the loss of personal and real <br />property and further, provided it receives the affirmative vote of two-thirds of all members of the <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: <br />First Reading: <br />Second Reading:, { kv;(?jj <br />Third Reading: <br />Committee: <br />ATTE?T.• <br />MARIE GALLO <br />Clerk of Council <br />APPROVED: ,,?/ ?`?
