... individual person employed by said company obtains or maintains a valid certificate and <br />provides direct supervision of all work in lieu of the corporate personnel under sanction. <br />(b) No person, firm, corporation or contractor shall knowingly subcontract to any second <br />party when that party does not possess a current certification of registration-or local license. <br />1317.99 PENALTY. <br />(a) In addition to any other civil or criminal penalties, any person, firm, corporation or <br />contractor who engages in the work or trade of a contractor without first acquiring a certificate of <br />registration or, where applicable, a local license; or otherwise violates Section 1317.05 and <br />1317.09, shall be subject to one or more of the following penalties: <br />(1) A monetary penalty of twice the annual certification fee and, after Notice to <br />Stop Work is issued, a per diem monetary penalty of the same amount; and <br />(2) The Building Commissioner shall order compliance with any and all <br />violations of this Building Code charged on the records to the holder of such <br />suspended or revoked certificate or collect from the applicant, as a penalty for <br />violation, the reasonable costs of correcting such violations, together with interest <br />from the date of violation; and <br />(3) In addition to penalties upon the subcontractor in violation, any general <br />contractor in violation of Section 1317.09(b), shall be fined twice the annual <br />certification fee for each violation, and, match the fine levied upon the <br />subcontractor, whether or not said subcontractor pays said fine. <br />(b) In addition to any other civil or criminal penalties, any person whose certificate has <br />been suspended or revoked pursuant to Section 1317.06 shall be subject to the following <br />penalties: <br />(1) No building permits may be issued during such suspension or revocation <br />period and, upon application for reinstatement and payment of the fees attendant <br />thereto, a monetary penalty shall be imposed in an amount equal to twice the <br />annual renewal fees that would otherwise have been paid from the date of the <br />suspension; and <br />(2) The Building Commissioner shall order compliance with any and all <br />violations of this Building Code charged on the records to the holder of such <br />suspended or revoked certificate or collect from the applicant, as a penalty for <br />violation, the reasonable costs of correcting such violations, together with interest <br />from the date of violation. <br />(c) Any violation of Section 1317.05 or Section 1317.09 shall constitute a <br />misdemeanor of the first degree.
