CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2013 - 37 <br />By: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MAYOR TO IMPLEMENT A <br />DESIGN / BUILD SELECTION PROCESS FOR THE AWARD OF A <br />CONTRACT TO DESIGN AND INSTALL IMPROVEMENTS TO THE <br />LIGHTING SYSTEMS FOR THE ICE RINK, POOL, TENNIS AND <br />GYMNASTICS AREAS AT THE RECREATION CENTER, AND <br />AUTHORIZING THE MAYOR, FOLLOWING APPROVAL OF THE BOARD <br />OF CONTROL, TO CONTRACT FOR THE SAME WITH THE <br />SUCCESSFUL APPLICANT, AND DECLARING AN EMERGENCY. <br />WHEREAS, on November 2, 2010, the electors of the City of North Olmsted amended <br />Charter Art. VIII, §6, to permit a design build process as a means of awarding contracts within <br />the City of North Olmsted; and <br />WHEREAS, the Recreation Commissioner has identified a need to update and improve <br />the lighting for the ice rink, pool, tennis and gymnastics areas at the Recreation Center and <br />F? <br />? established design criteria based on the quality and cost of such improvement and services; and <br />WHEREAS, the City believes that contractors skilled in the design and installation of <br />lighting systems are adequately prepared to identify the need and selection of proper equipment <br />to ensure the public health, safety and welfare; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to solicit proposals for <br />the construction and installation of lighting improvements, and to further authorize the Mayor to <br />enter into a contract with the successful applicant, after Board of Control approval. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to solicit proposals for the <br />design and construction of lighting improvements for the ice rink, pool, tennis and gymnastics <br />areas at the North Olmsted Recreation Center according to design criteria on file. <br />SECTION 2: A committee consisting of the Safety/Service Director, the City Engineer, <br />the Building Commissioner and the Recreation Commissioner shall prepare and approve <br />amendments to design criteria and shall arrange for a solicitation process and method by which <br />interested applicants can view, test or analyze the existing facilities in order to design a <br />responsive system. <br />SECTION 3: In the event of not less than two (2) qualified submittals by an established <br />deadline, the timely submittals shall be reviewed for qualifications and costs by a committee
