CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2013 - 41 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING CHAPTER 1321 OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED <br />"PERMIT AND INSPECTION FE'ES"; AND , DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, the Building Commissioner and the Director of Planning & Development <br />recommend that Chapter 1321, Permit and Inspection Fees, be updated in order to eliminate <br />contractor registration fees which are separately addressed by Chapter 1317 and to address <br />addition amendments to clarify application, eliminate redundancy and streamline administration; <br />and <br />WHEREAS, the Building Commissioner and the Director of Planning & Development <br />further recommend the update of Chapter 1321, Permit and Inspection Fees, in order to increase <br />fees and charges to reflect the rising administrative costs of providing plan review, building <br />inspection and related services, including trade permit fees, which have not been increased in <br />over ten (10) years (Ord. No. 2002-192); and <br />WHEREAS, it is the desire of this Council to amend Chapter 1321 of the Codified <br />Ordinances of the City of North Olmsted in order to update fees and clarify Code application as <br />it concerns building inspections. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 1321 "Permit and Inspection Fees" which presently reads in <br />its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by <br />reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety <br />as such amendments are displayed by boldface and as stricken in Exhibit B. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance to go into effect immediately in order to <br />update fee structure in relation to administrative cost of services; and further provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: First Reading: <br />- Second Reading.• ,? ?6o t" ' 13 ?:?
