CITY OF NORTH OLMSTED ORDINANCE NO. 2013 - 41 BY: Mayor Kennedy AN ORDINANCE AMENDING CHAPTER 1321 OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED "PERMIT AND INSPECTION FE'ES"; AND , DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, the Building Commissioner and the Director of Planning & Development recommend that Chapter 1321, Permit and Inspection Fees, be updated in order to eliminate contractor registration fees which are separately addressed by Chapter 1317 and to address addition amendments to clarify application, eliminate redundancy and streamline administration; and WHEREAS, the Building Commissioner and the Director of Planning & Development further recommend the update of Chapter 1321, Permit and Inspection Fees, in order to increase fees and charges to reflect the rising administrative costs of providing plan review, building inspection and related services, including trade permit fees, which have not been increased in over ten (10) years (Ord. No. 2002-192); and WHEREAS, it is the desire of this Council to amend Chapter 1321 of the Codified Ordinances of the City of North Olmsted in order to update fees and clarify Code application as it concerns building inspections. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Chapter 1321 "Permit and Inspection Fees" which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as such amendments are displayed by boldface and as stricken in Exhibit B. SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or inconsistent provisions of any Ordinance shall be corrected at re-codification. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Ordinance to go into effect immediately in order to update fee structure in relation to administrative cost of services; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
