NextPage LivePublish <br />Page 4 of 4 <br />Details for installations other than brick pavers shall be approved by the City Engineer. The limits of <br />brick paver installation and curb replacement shall be as directed by the City Engineer. The color shall <br />be red brick or earthtone colors as approved by the Architectural Review Board. <br />(Ord. 99-67. Passed 8-17-99.) <br />901.08 BARRIERS AND WARNING DEVICES. <br />(a) Any time a permit is issued pursuant to Sections 901.01 and 901.07, the contractor making <br />application during the excavation period and prior to the final completion of work as specified in Section <br />901.04, shall provide suitable barriers, warning devices and/or lights, all of which shall be in accordance <br />with the direction of the City Engineer. <br />(b) If the City Engineer should determine that the items specified in subsection (a) hereof are <br />insufficient and a flagman will be required, then the contractor shall present to the City Engineer <br />evidence that a flagman will be on duty to direct traffic at times when the City Engineer deems <br />necessary or appropriate. <br />(c) In the event a permit is not issued, as in the case of a government project, i.e., Federal, State, <br />County or City, the same requirements shall apply as are outlined in subsections (a) and (b) hereof. <br />(Ord. 94-57. Passed 4-19-94.) <br />901.99 PENALTY. <br />Any person, firm or corporation who shall make any opening or remove the pavement in any street, <br />boulevard, avenue or public ground of the City without having first obtained a permit from the <br />Engineering Division and having deposited with the City the estimated cost of repairing such work or <br />filing the bond hereinbefore set forth, is guilty of a misdemeanor of the fourth degree. Any such <br />violation shall constitute a separate offense on each successive day continued. <br />(Ord. 96-26.
