CITY OF NORTH OLMSTED ORDINANCE NO. 2013 - 50 By: Mayor Kennedy AN ORDINANCE ADOPTING AND IMPLEMENTING THE PROCEDURES UNDER CHAPTER 5722 OF THE OHIO REVISED CODE TO FACILITATE REUTILIZATION OF NONPRODUCTIVE LAND SITUATED WITHIN THE CITY OF NORTH OLMSTED, OHIO; AND DECLARING AN EMERGENCY. WHEREAS, Chapter 5722 of the Ohio Revised Code sets forth procedures to facilitate the effective reutilization of nonproductive land situated within municipal corporation boundaries; and WHEREAS, there exists nonproductive land within the boundaries of the City of North Olmsted which is of such nature and extent to necessitate the implementation of a land reutilization program to foster either the return of such nonproductive land to tax revenue generating status or the devotion thereof to public use. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, STATE OFOHIO, THAT: SECTION 1: This Council finds that the existence of nonproductive land within the boundaries of the City of North Olmsted, as such land is defined in Section 5722.01 of the Ohio Revised Code, is such as to necessitate the implementation of a land reutilization program to foster either the return of such nonproductive land to tax revenue generating status or the devotion thereof to public use. SECTION 2: The City of North Olmsted hereby adopts, implements and agrees to abide by the provisions of Chapter 5722 of the Ohio Revised Code for a land reutilization program as therein provided. SECTION 3: The Law Director shall make inquiry of County Officials and shall participate in necessary administrative and judicial actions to obtain possession and title to such lands. SECTION 4: The Clerk of Council is hereby authorized and directed, upon the passage of this Ordinance, to transmit certified copies to the County Auditor, the County Treasurer, and the County Prosecutor, as provided in Section 5722.02 of the Ohio Revised Code. SECTION 5: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further ?. for the reason that it is necessary that this Ordinance go into effect immediately so as to immediately address the problems associated with nonproductive land within the City, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
