CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2013 - 50 <br />By: Mayor Kennedy <br />AN ORDINANCE ADOPTING AND IMPLEMENTING THE PROCEDURES <br />UNDER CHAPTER 5722 OF THE OHIO REVISED CODE TO FACILITATE <br />REUTILIZATION OF NONPRODUCTIVE LAND SITUATED WITHIN THE <br />CITY OF NORTH OLMSTED, OHIO; AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Chapter 5722 of the Ohio Revised Code sets forth procedures to facilitate <br />the effective reutilization of nonproductive land situated within municipal corporation <br />boundaries; and <br />WHEREAS, there exists nonproductive land within the boundaries of the City of <br />North Olmsted which is of such nature and extent to necessitate the implementation of a <br />land reutilization program to foster either the return of such nonproductive land to tax revenue <br />generating status or the devotion thereof to public use. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, STATE OFOHIO, THAT: <br />SECTION 1: This Council finds that the existence of nonproductive land within the <br />boundaries of the City of North Olmsted, as such land is defined in Section 5722.01 of the <br />Ohio Revised Code, is such as to necessitate the implementation of a land reutilization program <br />to foster either the return of such nonproductive land to tax revenue generating status or the <br />devotion thereof to public use. <br />SECTION 2: The City of North Olmsted hereby adopts, implements and agrees <br />to abide by the provisions of Chapter 5722 of the Ohio Revised Code for a land reutilization <br />program as therein provided. <br />SECTION 3: The Law Director shall make inquiry of County Officials and shall <br />participate in necessary administrative and judicial actions to obtain possession and title to such <br />lands. <br />SECTION 4: The Clerk of Council is hereby authorized and directed, upon the <br />passage of this Ordinance, to transmit certified copies to the County Auditor, the County <br />Treasurer, and the County Prosecutor, as provided in Section 5722.02 of the Ohio Revised Code. <br />SECTION 5: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />?. for the reason that it is necessary that this Ordinance go into effect immediately so as to <br />immediately address the problems associated with nonproductive land within the City, and <br />further provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor.
