CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2013 - 59 <br />By: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO A <br />CONTRACT WITH THE CONTRACTOR SUBMITTING THE LOWEST <br />AND BEST CONSTRUCTION PROPOSAL, AS APPROVED BY THE <br />BOARD OF CONTROL, FOR CONSTRUCTION SERVICES TO PERFORM <br />THE SPRINGVALE GOLF COURSE BIO-RETENTION PROJECT, <br />PURSUANT TO SPECIFICATIONS ON FILE WITH THE CITY <br />ENGINEER, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted was awarded a Surface Water Improvement Fund <br />("SWIF") grant from the Ohio EPA for the Springvale Golf Course Bio-retention Project; and <br />WHEREAS, the project will involve replacing portions of existing pavement within the <br />parking field with a bio-retention swale; and <br />WHEREAS, the grant is in the amount of $47,772.00; and <br />WHEREAS, the Springvale Golf Course Bio-retention Project engineering estimate is <br />? less than Fifty Thousand Dollars ($50,000.00) and is not legally required by the City Charter to <br />? be competitively bid; and <br />WHEREAS, time is of the essence, as construction must be completed by September 30, <br />2013 to ensure compliance with grant guidelines; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to solicit contractor <br />construction proposals for construction services for the Springvale Golf Course Bio-retention <br />Project and, upon approval by the Board of Control, to enter into a contract with the contractor <br />submitting the lowest and best proposal. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to solicit contractor <br />proposals for construction services for the Springvale Golf Course Bio-retention Project in an <br />objectively competitive manner and, upon approval by the Board of Control, to enter into a <br />contract with the contractor submitting the lowest and best proposal, not to exceed $50,000.00. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is necessary that this Resolution go into effect immediately to ensure <br />construction completion by the grant-mandated deadline of September 30, 2013; and further
