CITY OF NORTH OLMSTED RESOLUTION NO. 2013 - 73 BY: Mayor Kennedy A RESOL UTION A UTHORIZING THE MAYOR TO RENEW THE CONTRACT BETWEEN THE CITY AND KARRIE SKALL TIPTON / NORTH OLMSTED GYMNASTICS. INC. FOR THE PROVISION OF PROFESSIONAL GYMNASTICS INSTRUCTION SERVICES AT THE NORTH OLMSTED RECREATION CENTER FOR ANADDITIONAL TERM OF FIVE (S) YEARS, AND DECLARING AN EMERGENCY, A.S AMENDED. WHEREAS, Karrie Skall Tipton has, pursuant to a series of contracts authorized by this Council, provided gymnastics program services at the City's Recreation Center since 1999; and WHEREAS, it is the recommendation of the Mayor that the current contract between the City and Ms. Tipton /North Olmsted Gvmnastics, Inc. be renewed for an additional five year term, for the period September 1, 2013 through August 31, 2018; and WHEREAS, it is the desire of this Council to dispense with initiating an RFP or RFQ process for said services and to approve and authorize the renewal contract with Ms. Tipton / North Olmsted Gvmnastics. Inc in substantially the form as attached hereto, to provide for the contract to be effective as of September 1, 2013, and to authorize the Mayor to execute said contract. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to execute a renewal contract with Karrie Skall Tipton / North Olmsted Gvmnastics, Inc. in substantially the form and substance as evidenced in the Agreement far Gymnastic Instruction Services, attached to this Ordinance as "Exhibit A," with only such changes to said contract to be hereinafter made as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreements by the Mayor and the approval of the agreements by the Director of Law. Said Contract shall be for a five year term effective September 1, 2013 and, unless further renewed, concluding on August 31, 2018. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety, and welfare. and for the further reason it is necessary that this legislation go into effect immediately in order that the City to provide continuing gymnastics programming to the residents of the City of North Olmsted and
