CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2013 - 80 <br />BY: Mayor Kennedy <br />A RESOLUTION DISPENSING WITH THE FORMAL RFP PROCESS AND <br />AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH <br />POLY-TECH ASSOCIATES IN ORDER TO PROVIDE THE CIVIL <br />SERVICE COMMISSION WITH CONSULTING SERVICES FOR <br />COMPETITIVE EXAMINATIONS, AND DECLARING AN EMERGENCY. <br />WHEREAS, Poly-Tech Associates was previously retained, following interviews by the <br />Civil Service Commission, to provide the City with consulting services, including testing <br />materials and administrative services, for competitive examination based on fee for service <br />contract price not to exceed $25,000.00 or two year terms, whichever comes first; and <br />WHEREAS, the Civil Service Commission has previously received and reviewed several <br />proposals from various testing companies and has recommended that this Council authorize the <br />Mayor to renew the agreement with Poly-Tech Associates; and <br />WHEREAS, Section 112.10(c) of the Administrative Code provides, as an exception to <br />the RFP process, that the City may, upon approval of the Council, dispense with a formal RFP if <br />the services sought are of such a unique or specialized nature that conducting a formal RFP will <br />likely not result in obtaining proposals from two qualified firms; <br />WHEREAS, it is the desire of this Council, based upon the recommendation of the Civil <br />Service Commission, to authorize the Mayar to enter into a renewal agreement with Poly-Tech <br />Associates to provide such consulting services; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That the Mayor be, on behalf of the City of North Olmsted, and he is <br />hereby authorized to enter into an Agreement with Poly-Tech Associates, to provide for civil <br />service testing service, including consultation, administration, and testing materials for the Civil <br />Service Commission to administer ongoing entry level and/or promotional testing, as may be <br />needed, for the contract price not to exceed Twenty Five Thousand ($25,000.00) or two year <br />term, whichever occurs first. Said Agreement shall be in the form and substance of the <br />Examination Agreement attached to this legislation as Exhibit A, with such changes in form and <br />substance that are not substantially adverse to the City and which are approved by the Director of <br />Law. The character of the agreement as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the agreement by the Mayor and the approval of the <br />contract by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, health, safety and welfare of the <br />City of North Olmsted, Ohio and for the further reason that it is necessary that this Resolution go <br />into effect immediately because the Civil Service Commission requires immediate consulting <br />services in order to address ongoing testing requests, and further provided that it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor.
