CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2013 - 81 <br />By: Mayor Kennedy <br />A RESOL UTION DECLARING CONDITIONS WITHIN THE SENIOR <br />CENTER TD BEA REAL AND PRESENT EMERGENCYNECESSITATING <br />ACTION WITHOUT PUBLIC BIDDING AS REQUIRED BY NORTH <br />OLMSTED CHARTER ART. VIII, SECTION 6 AND FURTHER <br />A UTHORIZING THE MA YOR TO ENTER INTO A CONTRA CT WITH <br />DOVER HOME REMODELERS, INC., TO REMOVE AND REPLACE <br />CEILING TILES AND OTHER WISE REPAIR Wfl TER DAMAGE CA USED <br />BY ROOF LEAKS, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to Resolution No. 2013-45, passed 5/7/13, the City entered into an <br />Agreement with West Roofing Systems, Inc., to perform roof repairs at the Senior Center; and <br />WHEREAS, the roofing project was thereafter initiated but on June 26 & 27, 2013, the <br />Contractor neglected to cover the roof and the City experienced extensive water leakage and <br />interior damage, which has prompted emergency recovery actions and insurance claims for <br />damages; and <br />WHEREAS, in addition to these storm events, the City has continued to experience water <br />leakage and has required the Contractor to address defective conditions, which has prompted <br />removal and repair of sections of the roof and further evaluation of claims; and <br />WHEREAS, the City requested quotes to address immediate, emergency repairs by and <br />through Dover Home Remodelers, Inc. at a cost of 100,510.43; and <br />WHEREAS, the time associated with advertising for bid requirements will expose the <br />building to additional water damage and unduly extend the time of diminished senior services; <br />and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a contract <br />with Dover Remodelers, Inc., for emergency repairs at the Senior Center, as set forth in <br />Agreement proposed herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: The conditions within the Senior Center as a consequence of storm events <br />and water leakage through the roof; as detailed herein, are a current and present emergency, <br />requiring immediate action as an exception to public bidding as set forth in Charter Art. VIII, §6. <br />in order to preserve the public liealth, safety and welfare.
