CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2013 - 83 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING CHAPTER 513 OF THE GENERAL <br />OFFENSES CODE OF THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED ENTITLED "DRUG ABUSE CONTROL" IN ORDER <br />TD CREATE A LOCAL CODE PROVISION MAKING ILLEGAL THE <br />POSSESSION OF MARIHUANA DR UG PARAPHERNALIA. <br />WHEREAS, the codified ordinances of the City of North Olmsted do not presently <br />include a prohibition of possessing marihuana drug paraphernalia; and <br />WHEREAS, North Olmsted Codified Ordinance 513.04 regulates the possession of drug <br />abuse instruments that allow for the administration of dangerous drugs, except marihuana; and <br />WHEREAS, R.C. §2925.141 makes the possession or use of drug paraphernalia for the <br />administration of marihuana a minor misdemeanor. <br />WHEREAS, it is the desire of this Council, upon the recommendations of the <br />Administration, to amend and General Offenses code of the City of North Olmsted to create a <br />local prohibition for the possession or use of marihuana paraphernalia. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 513.15 of Chapter 513 of the General Offenses Code entitled <br />"Illegal Use or Possession of Marihuana Paraphernalia" is hereby adopted and, as adopted, shall <br />reads as follow: <br />513.15 ILLEGAL USE OR POSSESSION OF MARIHUANA DRUG PARAPHERNALIA <br />(a) As used in this section, "drug paraphernalia" has the same meaning as in Section <br />753.04 of the Coditied Ordinances of the City of North Olmsted. <br />(b) In determining if any equipment, product, or material is drug paraphernalia, a court or <br />law enforcement officer may consider, in addition to other relevant factors, all factors identified <br />in Section 753.05 of the Codified Ordinances of the City of North Olmsted. <br />(c) No person shall knowingly use, or possess with purpose to use, any drug <br />parapl;ernalia that is equipment, a product, or material of any kind that is used by the person, <br />intended by the person for use, or designed for use in storing, containing, concealing, injecting, <br />ingesting, inhaling, or otherwise introducing into the human body marihuana.
