CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2013 - 84 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 351.20 OF THE TRAFFIC CODE <br />OF THE CITY OF NORTH OLMSTED ENTITLED "HANDICAPPED <br />PARKING" IN ORDER TO ESTABLISH JURISDICTION IN THE NORTH <br />OLMSTED MAYOR'S COURT FOR THE PROSECUTION OF <br />HANDICAPPED PARKING TICKET VIOLATIONS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City of North Olmsted Mayor's Court commenced operations on <br />January 1, 2013; and <br />WHEREAS, the Traffic Code presently establishes jurisdiction to administer and <br />prosecute Traffic Code Violations, specifically Handicapped Parking Tickets, within the Rocky <br />River Municipal Court; and <br />WHEREAS, it is the recommendation of the Administration that Section 351.20 of the <br />Traffic Code of the City of North Olmsted entitled "Handicapped Parking" be amended to create <br />concurrent jurisdiction for prosecution in both Rocky River and the City of North Olmsted <br />Mayor's Court; and <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration, to establish jurisdiction for such prosecutions in both the Rocky River Municipal <br />Court and the North Olmsted Mayor's Court. <br />NOW THEREFORE, BE IT ORDAINED BY THE CDUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That section 351.20 of the Traffic Code which presently reads as follows: <br />351.20 HANDICAPPED PARKING <br />(a) Special parking locations and privileges for persons with disabilities that limit or impair the <br />ability to walk, also known as handicapped parking spaces or disability parking spaces shall be <br />provided and designated by the Municipality and all agencies and instrumentalities thereof at all <br />offices and facilities, where parking is provided, whether owned, rented or leased, and at all <br />publicly owned parking garages. The locations shall be designated through the posting of an <br />elevated sign, whether permanently affixed or movable, imprinted with the international symbol <br />of access and shall be reasonably close to exits, entrances, elevators and ramps. All elevated <br />signs posted in accordance with this subsection and Ohio R.C. 3781.111 (C) shall be mounted on <br />a fixed or movable post, and the distance from the ground to the bottom edge of the sign shall <br />measure not less than five feet.
