NOW THEREFORE, the CITY and BUILDING COMMISSIONER, each <br />acknowledging the sufficiency of the consideration contained in the terms and conditions of the <br />Agreement, agree as follows: <br />SECTION 1. BASIC SERVICES. <br />1.1 The BASIC SERVICES shall be the services set forth below in 1.2. Such services <br />shall be performed by BUIDING COMMISSIONER and shall encompass services as the CITY's <br />Building Commissioner. Said Building Commissioner shall have the qualifications required by <br />CITY ordinances and state law. <br />1.2 In consideration for providing the basic services, the CITY shall pay the <br />BUILDING COMMISSIONER a retaining fee in the sum of Forty Thousand Dollars <br />($40,000.00) per annum. The retaining fees shall be paid on a biweekly basis commencing upon <br />the effective date of this Agreement, and the amounts shall be subject to the contribution by the <br />CITY and said building official, respectively, to PERS. In consideration of said retaining fees, <br />the BUILDING COMMISSIONER shall provide the following basic services: <br />(a) BUILDING COMMISSIONER shall give information and advice, as needed and <br />as directed and/or authorized by the Director of Planning and Development, to <br />Council, the Mayor, Directors and_Division Heads, residents, builders, etc. and <br />other administrative officials on issues that arise in the CITY pertaining to <br />building, zoning, planning and development, etc. <br />(b) BUILDING COMMISSIOER shall review, as needed and as directed and/or <br />authorized by the Director of Planning and Development, formative or <br />preliminary sketches, development proposals, layouts, estimates or reports, <br />concerning the presentation of commercial or residential development plans as <br />well as any public improvements contemplated by the CITY. <br />(c) BUILDING COMMISSIONER shall make recommendations, as directed and/or <br />authorized by the Director of Planning and Development, regarding the building <br />features of development plans, including review for compliance with building and <br />zoning codes and supervise staff in the performance of such review as building <br />official. <br />2
