. ?. <br />Resolution No. 2006-175 <br />WHEREAS, it is the desire of this Council, accordingly, to authorize the Director of Law <br />to prepare, file and prosecute Motions in the Cuyahoga County Common Pleas Court to Vacate <br />and/or Modify the said adverse arbitration awards, and to take such other and further appropriate <br />legal action, including further appeals, to vacate and/or modify said arbitration awards; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Law be and he hereby is authorized and directed to <br />prepare, file and prosecute A Motion in the Cuyahoga County Common Pleas Court to Vacate <br />and/or Modify the following labor arbitration awards, to wit: North Olmsted Fire Fighters, IAFF <br />Local 1267, AFL/CIO and City of North Olmsted, Ohio, FMCS Case No 040630-5932-8, decided <br />July 30, 2006, by Arbitrator Carrie Donald, and to take such other and further legal action to <br />vacate and/or modify the said arbitration award, including taken further appeals, as he, in his <br />professional judgment, deems necessary and appropriate. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is necessary that this legislation go into effect immediately because the <br />deadline for filing a Motion to Vacate the adverse arbitration award is October 30, 2006, and <br />further provided that it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATTE • <br />??d_ C? <br />BA BARA L.
