J CITY OF NORTH OLMSTED RESOLUTION NO. 2006 -166 BY: Mayor O'Grady and Council Members Gareau and Ryan A RESOL UTION DISPENSING WITH THE CITY'S FORMAL RFP PROCESS AND AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT, IF NECESSARY, WITHAAPEXANALYTICAL, INC., DBA AUBURN ENVIRONMENTAL, TO PROVIDE AIR QUALITY TESTING SERVICES TO THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, this Council may, during emergency circumstances, dispense with the ]R.FP process required for the procurement of professional services required by Sections 111.03 et seq. of the Codified Ordinances of the City; and WHEREAS, this Council believes that an air quality nuisance condition affecting the health of nearby residents may exist in the vicinity of the Suburban Auto body shop located at 26618 Brookpark Road Extension, which constitutes such an emergency circumstance; and WHEREAS, it is the desire of this Council to provide the Mayor with authority to immediately enter into a contract, if necessary, with Aapex Analytical, Inc., dba Auburn Environmental, in order to provide the necessary air quality testing services to the City in order to determine whether such an air quality nuisance condition exists in the City; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the City Administration is authorized to dispense with the formal RFP process required by Sections 111.03 et seq. of the Codified Ordinances and the Mayor be and he hereby is authorized to immediately enter into a contract, if necessary, with Aapex Analytical, Inc., dba Auburn Environmental, to provide air quality testing services to the City of North Olmsted to determine air quality in the vicinity of the Suburban Auto body shop located at 26618 Brookpark Road Extension. Said agreement shall be in a form and substance acceptable to the Mayor and approved by the Director of Law as not substantially adverse to the City. The character of any such agreement as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and its approval by the Director of Law. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the reason that it is necessary that this Resolution go into effect immediately in order to enable the City to conduct air quality testing in the City of North Olmsted to resolve a possible air quality nuisance condition, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
