J <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 -166 <br />BY: Mayor O'Grady and Council Members Gareau and Ryan <br />A RESOL UTION DISPENSING WITH THE CITY'S FORMAL RFP PROCESS <br />AND AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT, IF <br />NECESSARY, WITHAAPEXANALYTICAL, INC., DBA AUBURN <br />ENVIRONMENTAL, TO PROVIDE AIR QUALITY TESTING SERVICES TO <br />THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council may, during emergency circumstances, dispense with the ]R.FP <br />process required for the procurement of professional services required by Sections 111.03 et seq. <br />of the Codified Ordinances of the City; and <br />WHEREAS, this Council believes that an air quality nuisance condition affecting the <br />health of nearby residents may exist in the vicinity of the Suburban Auto body shop located at <br />26618 Brookpark Road Extension, which constitutes such an emergency circumstance; and <br />WHEREAS, it is the desire of this Council to provide the Mayor with authority to <br />immediately enter into a contract, if necessary, with Aapex Analytical, Inc., dba Auburn <br />Environmental, in order to provide the necessary air quality testing services to the City in order <br />to determine whether such an air quality nuisance condition exists in the City; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the City Administration is authorized to dispense with the formal <br />RFP process required by Sections 111.03 et seq. of the Codified Ordinances and the Mayor be <br />and he hereby is authorized to immediately enter into a contract, if necessary, with Aapex <br />Analytical, Inc., dba Auburn Environmental, to provide air quality testing services to the City of <br />North Olmsted to determine air quality in the vicinity of the Suburban Auto body shop located at <br />26618 Brookpark Road Extension. Said agreement shall be in a form and substance acceptable <br />to the Mayor and approved by the Director of Law as not substantially adverse to the City. The <br />character of any such agreement as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the agreement by the Mayor and its approval by the Director of <br />Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that it is necessary that this Resolution go into effect immediately in order to enable the <br />City to conduct air quality testing in the City of North Olmsted to resolve a possible air quality <br />nuisance condition, and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor.
