<br />?.< <br />CITY OF NORTH OLMSTED ' <br />ORDINANCE NO. 2006 -161 ' <br />BY: Council Member Orlowski <br />WHEREAS, it is the desire of this Council to regulate the storage of snow/ice removal <br />equipment on commercial, business retail, mixed use and multi-family properties in order to <br />protect and preserve the health, safety and welfare of the community; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLSMTED, CIIYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Section 763.03 in Chapter 763 <br />(Retail Business Regulations) of the Business Regulation Code, which, as created, shall read in <br />its entirety as follows: <br />763.03. STORAGE OF SNOW/ICE REMOVAL EQUIPMENT ON <br />COMMERCIAL, BUSINESS RETAIL, MIXED USE, OR MULTI-FAMILY <br />PROPERTIES. <br />(a) No owner, operator or tenant of any commercial, business retail, mixed use or multi- <br />family property shall store or place any snow/ice removal equipment upon such property <br />at any time between the dates of May 1 and October 15 each year. <br />(b) A violation of this section shall constitute a misdemeanor, punishable by a fine that <br />shall not be less than $300.00 nor exceed $1000.00. For purposes of this paragraph, each <br />day during which such violation continues shall constitute a separate violation. <br />AN ORDINANCE CREATING NEW SECTION 763.03 OF CHAPTER 763 <br />(RETAIL BUSINESS REGULATIONS) OF THE BUSINESS REGULATION <br />CODE IN ORDER TO REGULATE THE STORAGE OF SNOW/ICE <br />REMOVAL EQUIPMENT ON COMMERCIAL, BUSINESS RETAIL, MIXED <br />USE AND MULTI-FAMILY PROPERTIES. <br />SECTION 2: That this Ordinance shall take effect and be in force on and after the <br />earliest date provided for by law. <br />PASSED: <br />ATTEST.• <br />First Reading.• qllqjt)(. <br />Second Reading.• 'T14.o_t <br />Third Reading: <br />Committee: <br />BARBARA L.
