<br />AN ORDINANCE AMENDING SECTIONS ONE AND TWO OF
<br />ORDINANCE NO. 2006-79, WHICH PROVIDED FOR THE
<br />ADOPTION OF THE NEW RESIDENTIAL CODE OF OHIO
<br />FOR ONE-, TWO-, AND THREE-FAMILY DWELLINGS, IN
<br />ORDER TO CORRECT ERRONEOUS REFERENCES
<br />THEREIN TO THE 2004 RESIDENTIAL CODE.
<br />WHEREAS, this Council, on May 3, 2006, passed Ordinance No. 2006-79, which adopted
<br />the new Residential Code of Ohio for One-, Two-, and Three-Family Dwellings, a state-mandated
<br />Code that became effective in the State of Ohio on May 27, 2006; and
<br />WHEREAS, at Sections 1 and 2 of said Ordinance, the new Residential Code was
<br />erroneously referred to as the "2004 Residential Code," rather than the "2006 Residential Code;"
<br />and
<br />WHEREAS, it is desire of this Council, on the recommendation of the Building
<br />Commissioner and Director of Law, to correct Sections 1 and 2 of Ordinance No. 2006-79 in
<br />order to clearly state that this Council has adopted the 2006 Residential Code for One-, Two-, and
<br />Three-Family Dwellings, as required by law;
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
<br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
<br />SECTION 1: That Sections 1 and 2 of Ordinance No. 2006-79, which presently reads as
<br />follows:
<br />SECTION 1: That the City of North Olmsted hereby adopts the 2004 Residential Code of
<br />Ohio for one-, two-, and three-family dwellings.
<br />SECTION 2: That, as expressly set forth in Exhibit A, attached hereto and incorporated
<br />herein by reference as if fully restated herein, and in order to effectuate the adoption of the 2004
<br />Residential Code of Ohio for one-, two-, and three-family dwellings, the following changes in
<br />Chapters 1301, 1303, 1305, 1307, and 1309 of the North Olmsted Building Code are hereby
<br />adopted:
<br />(a) Section 1301.03 in Chapter 1301 is amended;
<br />(b) Chapter 1303 is deleted in its entirety;
<br />(c) Sections 1305.01, 1305.02, 1305.03, 1305.04, and 1305.05 of Chapter 1305 are
<br />amended, and new Section 1305.06 of the same Chapter is created;
<br />(d) Chapter 1307 is deleted in its entirety; and
<br />(e) Section 1309.01 of Chapter 1309 is amended, and Sections 1309.02, 1309.03,
<br />1309.04, 1309.05 and 1309.99 of the same Chapter are deleted in their entirety.
