<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 - 144 <br />BY: Mayor O'Grady <br />A RESOLUTION ACCEPTING A GRANT FROM THE OHIO <br />DEPARTMENT OF TRANSPORTATION (ODOT) FOR A MINOR <br />REHABILITATION OF GREAT NORTHERN BOULEVARD FROM <br />THE IR-480 EASTBOUND EXIT RAMP TO COUNTRY CLUB <br />BOULEVARD, AUTHORIZING THE MAYOR TO ENTER INTO A <br />LPA NON-FEDERAL LOCAL-LET PROJECT AGREEMENT WITH <br />ODOT SETTING FORTH THE TERMS AND CONDITIONS OF THE <br />GRANT, AND DECLARING AN EMERGENCY. <br />WHEREAS, on September 20, 2005, this Council adopted Resolution No. 2005-127, <br />authorizing the Mayor to make application on behalf of the City for an Ohio Public Works <br />Commission ("OPWC") Grant for the reconstruction of Great Northern Boulevard from NOMBL <br />Lane to Country Club Boulevard; and <br />WHEREAS, following the Mayor's application on behalf of the City for the said grant, <br />OPWC awarded the City a grant in the amount of One Million Forty Thousand Four Hundred <br />Thirty Four pollars ($1,040,434.00), which this Council accepted and authorized the Mayor to <br />execute pursuant to Resolution No. 2006-141; and <br />WHEREAS, in conjunction with the above-referenced more complex project, the Ohio <br />Department of Transportation ("ODOT") has awarded the City an additional grant in an amount <br />not to exceed Two Hundred Thousand Dollars ($200,000.00) for a minor rehabilitation of Great <br />Northern Boulevard from the IR-480 eastbound exit ramp to Country Club Boulevard, which <br />excludes the bridge surface; and <br />WHEREAS, it is the desire of this Council to accept the said grant from ODOT and <br />authorize the Mayor to enter into an LPA Non-Federal Local-Let Project Agreement with ODOT <br />providing for the terms and conditions upon which the said grant shall be made to the City; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF' <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City of North Olmsted accepts the ODOT grant in an amount not <br />to exceed Two Hundred Thousand Dollars ($200,000.00) for a minor rehabilitation of Great <br />Northern Boulevard from the IR-480 eastbound exit ramp to Country Club Boulevard, which <br />excludes the bridge surface, and authorizes the Mayor to enter into an LPA Non-Federal Local- <br />Let Project Agreement with ODOT providing for the terms and conditions of the said grant. Said <br />contract shall be in the form and substance of the LPA Non-Federal Local-Let Project <br />Agreement, which is attached to this legislation as Exhibit A, with such changes therein as are <br />not substantially adverse to the City. The character of the contract as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the agreement by the <br />Mayor and the approval of the agreement by the Director of Law.
