? <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 - 143 <br />By: Mayor O'Grady <br />? <br />? <br />A RESOL UTION A UTHORIZING THE MAYOR, ON BEHALF <br />OF THE CITY OF NORTH OLMSTED, TO ENTER INTO AN <br />AGREEMENT WITH THE BOARD OF CUYAHOGA COUNTY <br />COMMISSIONERS FOR THE ASSET TRANSFER OF <br />EQUIPMENT PURCHASED WITH FY2004 URBAN AREA <br />SECURITY INITIATIVE GRANT PROGRAM FUNDS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor has recommended that the City enter into an agreement with the <br />Board of Cuyahoga County Commissioners providing for the City to receive a generator and two <br />flood lighting tripods to be purchased by the County with FY2004 Urban Area Security Initiative <br />(UASI) grant funds not to exceed the amount of $2,680.88; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor, on behalf of the City <br />to enter into said agreement with the Board of Cuyahoga County Commissioners; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY 9F <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be, and he hereby is, authorized, on behalf of the City of <br />North Olmsted, to enter into an agreement with the Board of Cuyahoga County Commissioners <br />for the purposes of receiving title to and possession of a generator and two flood lighting tripods <br />to be purchased by the County with FY2004 Urban Area Security Initiative grant funds, in the <br />form of the Agreement marked as Exhibit A and attached hereto, with only such changes to be <br />hereinafter made as are not substantially adverse to the City and which are approved by the <br />Director of Law. The character of any such changes as not being substantially adverse to the City <br />shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval <br />of the Agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and fox the <br />further reason that it is necessary that this legislation go into effect immediately in order to meet <br />the August 16, 2006, response deadline established by the County; and further provided that it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor.
