<br />b'd" 611116-) <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2006 -129 <br />BY: Mayor O'Grady <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A <br />CONTRACT WITH CGI COMMUNICATIONS, INC. FOR THE <br />PURPOSE OF OBTAINING COMMUNITY VIDEO SHOWCASE AND <br />COMMUNITY BANNER SERVICES, BOTH SUPPORTED BY LOCAL <br />BUSINESS ADVERTISING, FOR THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, it is the desire of the Mayor to enter into a contract on behalf of the City <br />of North Olmsted with CGI Communications, Inc. for the purpose of obtaining community <br />video showcase services to the City website and community banners for installation in the <br />City right of way, both with the support of local business advertising; and <br />WHEREAS, whereas it is the desire of this Council to authorize the Mayor to enter <br />into said contract in order to obtain said services for the City; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into a contract <br />with CGI Communications, Inc. for the purpose of obtaining community video showcase <br />services for the City website and obtaining community banners to be installed in the City right <br />of way, both with the support of local business advertising. Said contract shall be <br />substantially in the form of the "Community Video, Banner Branding, & Business Showcase <br />Agreement," marked as Exhibit "A" and attached hereto, with only such changes therein as are <br />not substantially adverse to the City and which are approved by the Director of Law. The <br />character of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the agreement by the Mayor and the approval of the <br />agreement by the Director of Law. <br />SECTION 2: That by authorizing this contract, which is supported by local business <br />advertising on the City's website and upon banners to be installed in the City right of way, this <br />Council reaffirms, consistent with its purpose expressed in Section 177.02 of Chapter 177 <br />(Community Access) of the Administrative Code, that the City's website and the airspace <br />above the City's right of way are and continue to be nonpublic forums. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of <br />this City and for the reason that this Resolution go into effect immediately because the <br />provider has offered said contract to the City for a limited time only, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect and <br />be in force immediately upon its passage and approval by the Mayor.
