WO <br />?. . <br />.?,,... <br />- Ordinance No. 2006-128 <br />(3) "vehicle repair establishment" means any business located in a General Retail <br />Business District of the City, which repairs motor vehicles; the term shall include, <br />but not be limited to, service stations, auto repair facilities, and body shops. <br />(b) Every owner, operator or tenant of a vehicle repair establishment that conducts paint <br />spraying operations within 500 linear feet of any residential lot line shall do so only <br />within an enclosed building and shall at all times keep all external doors to the said <br />building, including service bay doors (overhead doors), closed except when persons or <br />vehicles are entering or leaving the building through such doors. Signs shall be posted by <br />all doors indicating that the doors must be closed at all times except to allow persons or <br />vehicles to enter or leave the building. <br />(c) A violation of this section shall constitute a misdemeanor, punishable by a fine that <br />shall not be less than $300.00 nor exceed $1000.00. For purposes of this paragraph, each <br />day during which such violation continues shall constitlite a separate violation. <br />SECTION 2: That all ordinances, and parts of ordinances, inconsistent or in conflict with <br />this Ordinance, shall, to the extent of such inconsistency or conflict, be repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />fiirther reason that it is necessary that this legislation go into effect immediately in order to <br />address an existing nuisance odor condition in one of the City's residential neighborhoods, and <br />fiu-ther provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />tal<e effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: <br />A TTEST.• <br />First Reading: ? 14 D 6 <br />Second Reading: j?
