6(? ? b17 <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2006 -124 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 927.10 OF <br />CHAPTER 927 (STORM WATER MANAGEMENT AND <br />URBAN SEDIMENT POLLUTION ABATEMENT SYSTEMS) <br />OF THE STREETS, UTILITIES AND PUBLIC SERVICES <br />CODE, IN ORDER TO ESTABLISH NEW GROUNDS FOR <br />GRANTING VARIANCES FROM THE STORM WATER <br />MANAGEMENT REQUIREMENTS OF SECTION 927.07(C), <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, a number of undeveloped properties in the City are not directly serviced by <br />storm water pipes/culverts and do not have direct access to natural channels; and <br />WHEREAS, it is the desire of this Council, in order to facilitate reasonable development <br />of such undeveloped properties, and at the same time protect the environment, to establish new <br />grounds for the granting of variances from the storm water management requirement of Section <br />927.07(c); <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 927.10 of Chapter 927 (Storm Water Management and Urban <br />Sediment Pollution Abatement Systems) of the Streets, Utilities and Public Services Code, which <br />presently reads as follows: <br />927.10 VARIANCE. <br />The City Council may grant a variance to these regulations where the owner or his <br />appointed representative can show that a hardship exists whereby compliance with these <br />regulations is not appropriate, based upon the following: <br />(a) That exceptional topographic ar other physical conditions exists which are <br />peculiar to the particular parcel of land; <br />(b) That the peculiar condition in paragraph (a) did not result from previous actions <br />by the owner. <br />Adverse economic conditions shall not be considered as a valid reason or a hardship for a <br />variance request to be granted. No variances will be granted where activities occur that will <br />defeat the purposes of regulations. <br />City Council may impose stricter requirements in some portion of a development to <br />compensate for a variance affecting a portion of the development.
