CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2006 - 122 <br />BY: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTION 1139.01 OF THE ZONING <br />CODE IN ORDER TO ELIMINATE THE LOCATIONAL AND <br />DENSITY REQUIREMENTS FOR PET S?'ORES AND ANIMAL <br />HOSPITALS IN GENERAL RETAIL BUSINESS DISTRICTS AS <br />TWICE AMENDED. <br />WHEREAS, Section 1139.01 (General Retail Business District) of the Zoning <br />Code, at paragraph (b)(4)(G), currently prohibits pet stores and animal hospitals, which <br />are permitted uses within general retail business districts, from being located within 700 <br />feet of any residential dwelling, and further limits the density of animals kept within any <br />building or buildings so used to fifty per acre; and <br />WHEREAS, the Director of Planning has recommended that the said <br />requirements be eliminated as inappropriate and too restrictive for commercial pet stores <br />and animal hospitals; and <br />WHEREAS, it is the desire of this Council to accordingly amend Section 1139.01 <br />of the Zoning Code in order to eliminate the said locational and density requirements for <br />pet stores and animal hospitals in general retail business districts; and <br />WHEREAS, the Planning & Design Commission on the /? day of <br />, 2006, by formal motion, (recommended - did not recommend) (with <br />ggested changes) that this Ordinance be adopted; and <br />WHEREAS, following publication of newspaper notice in conformance with the <br />provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and <br />Section 1127.03 of the North Olmsted Zong Code, a public hearing was held on this <br />proposed legislation on the V? day of 2006; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That Section 1139.01 of the Zoning Code, which presently reads as <br />follows: <br />1139.01 GENERAL RETAIL BUSINESS DISTRICT. <br />(a) Intent. For the purposes of the Zoning Code, General Retail Business Districts are <br />hereby established to meet the shopping, convenience and service needs of the residents <br />of the entire community.
