City Engineering Services <br />Page 4 of S <br />and the TOTAL PROPOSED COST FOR PROFESSIONAL SERVICES that will <br />be used by the Owner in negotiating the "not to exceed" cost that will be included <br />in the Agreement between the successful Proposer and the Owner. <br />VII. CON5IDERATION OF PROPOSAL5 <br />A. Any proposals submitted to the Owner are to be prepared at the Proposer's <br />expense. <br />B. Any assumptions made by the Proposer in preparing the proposal must be <br />listed separately and attached to the proposal in writing. <br />C. The Owner does not obiigate itself to accept any proposal. <br />D. The Owner reserves the right to reject any and all proposals and will have no <br />liability whatsoever to any Proposer whose proposal is not accepted. <br />E. Acceptance of a proposal will not constitute an agreement between tlle <br />Proposer and the Owner. Any proposal will not be binding on the Owner <br />unless and until an Agreement covering all conditions and provisions of the <br />Professional Services has been reduced to writing, executed by both the <br />successful Proposer and the Owner and attachment of the appropriate <br />certificates. <br />F. Along with the other criteria contained in the Codified Ordinances oi'the City <br />of North Olmsted, Ohio as set forth in APPENDIX E of this RFP, the <br />following criteria will be used to select the successful Proposer: <br />1. Understanding of the Project based on narratives contained in the <br />Proposal. <br />2. Experience of the Proposer to perform professional services for other <br />cities having comparable needs. <br />3. Experience of personnel who are to be assigned to the Project by the <br />Proposer as evidenced in resumes attached to its proposal and, if <br />completed by the City, post-proposal interviews. <br />4. Experience with other projects of the City of North Olmsted. <br />5. The Proposer's demonstration of its ability to perform the requested <br />services based on narratives contained in the Proposal, particularly: <br />a. Demonstrated ability to meet project schedules; and <br />b. The Total Proposed Cost submitted by the Proposer in its Proposal to <br />complete the scope of services in APPENDIX B of this Request for <br />proposal; <br />Demonstrated ability to provide professional engineering services for <br />other projects.
