Ordinance No. 2006-110 SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the Administrative Code is hereby dispensed with by reason of an emergency condition existing that requires immediate action, and the Mayor be and he hereby is authorized to enter into an agreement with Mayfield Engineering & Construction Management, Inc. to provide temporary engineering consulting services to the City Engineering Division for a second three month period. SECTION 2: Said extension agreement shall be in form and substance consistent with the current contract between the City and Mayfield Engineering & Construction Management, Inc., attached to this Ordinance as "Exhibit A," with only such changes therein as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public peace, health, safety and welfare, of this City and for the further reason that this Resolution is required to be immediately effective because of vital City construction projects underway that require engineering resources that the City presently does not have; and further provided it receives the affirtnative vote of two- thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
