Ordinance No. 2006-110 <br />SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the <br />Administrative Code is hereby dispensed with by reason of an emergency condition existing <br />that requires immediate action, and the Mayor be and he hereby is authorized to enter into an <br />agreement with Mayfield Engineering & Construction Management, Inc. to provide temporary <br />engineering consulting services to the City Engineering Division for a second three month <br />period. <br />SECTION 2: Said extension agreement shall be in form and substance consistent <br />with the current contract between the City and Mayfield Engineering & Construction <br />Management, Inc., attached to this Ordinance as "Exhibit A," with only such changes therein <br />as are not substantially adverse to the City and which are approved by the Director of Law. <br />The character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the agreement by the Mayor and the approval of <br />the agreement by the Director of Law. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of <br />this City and for the further reason that this Resolution is required to be immediately effective <br />because of vital City construction projects underway that require engineering resources that <br />the City presently does not have; and further provided it receives the affirtnative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />PASSED: 4, <br />AT EST.• <br />B RBARA L.
