Ordinance No. 800 <br />By Mr. Crider. <br />A,N QRDINANCE <br />DETERMINING TO PROCEED V:ITH THE IMPROVEiV;FNT OF ,P.NDRUS AVEIqUE, <br />FRONI THE BOULEVARD (NORTHERLY LIvD OF ANDFtUS AVENUE ) TO KENNEDY <br />RIDGE ROAD, BY GRA.DING, DRAINING- AND SLAGGING SAME. <br />B_i]:. IT ORDAINED by the Couneil of the Village of <br />North Qlmsted, State of Ohio: <br />Section 1. That it is hereby determined to proceed <br />with the improvement of 8ndrus Avenue, from the Boulevard <br />(northcrly end of Andrus Avenue) to Kennedy RidLe Road, by <br />gradinE, draininb and sla,"Lin6 same, in accordance with Resolu- <br />tion No. 1575 passed on the oth day of September 1949, and <br />in accordance with the plans, specifications, estimates and <br />profiles heretofore approaed and now on file in the office of <br />the Clerk. <br />Section 2. That all claims for damages resulting <br />therefrom shall be judicially inquired into after the completion <br />of the proposed improvement, and the solieitor be, and he is <br />hereby, autnorized and directed to institute proceedings in a <br />court of competent jurisdiction to inquire into such claims. <br />Section 3. That the cost of said improvement shall <br />be assessed by the foot front upon the followinb described lots <br />and lands, to wit, all lots and lands bounding and abutting upon <br />the proposed improvement, which said lots and lands are hereby <br />determined to be specially benefited by said improvement; and <br />the cost of said improvement shall include the expense of pre- <br />liminary and other slzrveys, of printing and publishin; the <br />notices, the cost of eonstr-uction, together with interest on <br />notes or bonds issued in anticipation of collection of deferred <br />assessments and all other necessary expenditures. <br />Section 4. That the assesvlTlET1tS so to be levied shall <br />be paid in five annual installmer_ts, with interest not to exceed <br />six per cent per annum on deferred payments, provided that the <br />ovyrner of any property assessed may, at his option, pay such <br />assessment in cash within thirty days from and af ter the passage <br />of the assessin,-,; Ordinance, in which case said assessment shall <br />not include any item of` interest upon notes or bonds to be issued <br />in anticipation of thE collection of deferred installments of <br />assessments. <br />Sectian 5. That notes or bonds of the Villa,e of <br />lJorth Olmsted shall be isstled in anticipation of the collection <br />of assessments by installments and in an amount equal thereto. <br />Section 6. That the remaindt-r of the entire cost of <br />said improvement not specially assessed, incluainG the cost of <br />intersections, shall be paid out of the General Fund or by the <br />issuance of bonds of the Village of North Olmsted for that purpose, <br />in the manner providea by law. <br />Section 7. That the Clerk be, and he is hereby <br />authorized and directed to advertise for bids for the construction <br />of said improvement accordinE to law. <br />Section S. That this Ordinance is hereby declared to <br />be an emergency measure, the emergency being that it is n.ecess <br />ary for the immediate preservation of public health, peace, <br />safety and welfare that this Ordinance be passed at once and shall <br />take effect and 'oe in force from and after its passage. <br />Passed Niarch 7, 1950. <br />E.
