OhDINANCE N0. 686 (Section 1178-42, Uhio Gen eral Code) <br />By Mr. Oldham <br />GRANTING DIRECTOR 0F HIGHW1IYS AUTHOnITY '20 NAINTAIR <br />STATE HIGHAAYS IiVSIDE VILLAGE CORPOI-ATIGN <br />'ddHEFtEAS, The Director of Highways, under Sec. 1178-42 of the Gene ral <br />Code of Uhio, is authorized to mainta.in. extensions of state highways within <br />the limits of the Village, and <br />vffER.EAS, atensions of atate Highways No. 541, 694, lie within <br />this ?illage, and <br />vVHERF,ASP The work proposed to be authorized under this ordinance shall <br />be restricted to ger.eral maintenance of the t ravelled roadway surfaces of the <br />State Highwags hereinbefore set out, and <br />WHER?,,'AS, It is understood that this ordinance shall not in any way <br />ibligate the State of Ohio to repair pavements or roadway surfaces damaged by <br />the repair, removal or installation of subsurfaca ut'ility lines, and ' <br />4HER&AS, This ordinance in no manner r:lieve or discharge the said <br />Village from any clai.m or claims o.f any nature arising from, or growing out of, <br />the maintenance by the Department of Highways of the State of Uhio of said highways <br />in said Village, and the said village shall save the State of Ohio harmless <br />from any and all such claims, <br />NO:v, TKEREFORE, <br />Be it OUf1INED, th the Council of the Village of North 0lmsted, <br />North Olmsted, Ohio: <br />SEC`PION 1: It is h°reby declared to be in the public interest that <br />the consent of said village be, and said consent hereby is, given to the <br />Department of Highways of the State of Ohio for said Department to maintain the <br />travelled portions of the State HirThways hereinbefore set out. <br />Said village shall save t he Department of Highways of the state of Uhio <br />and the State of Ohio from any and all claims of any nature arising from or <br />growing out of the maintenance of the highways within said village as aforesaid. <br />SEC`PION 2. That the Clerk be, and he hereby is, directed to furnish to <br />the Directo r of Highways and to the Board of County Commissioners of Cuyahoga <br />County, Ohio, a certified copy of this Ordi.nance immediately upon the taking <br />effect thereof. <br />SECTION 3.
