. ~..., __ ..~_._,„,,:M~,„ CITY OF NORTH OLMSTED ORDINANCE NO.94- i 74 BY: COUNCILMAN DAVID LIND AN ORDINANCE AMENDING THE TRAFFIC CONTROL FILE OF THE CITY OF NORTH OLMSTED BY PROVIDING FOR THE REMOVAL OF "NO PARSING" SIGNS ON LeBERN DRIVE FROM CLAGUE ROAD WEST TO HAWKINS ROAD, AND DECLARING AN EMERGENCY. WHEREAS, this Council has determined that it is in the best interest of the safety, health, and welfare of the citizens of North Olmsted to remove the "No Parking" signs on LeBern Drive between Clague Road and Hawkins Road, in order to permit parking on the North side of LeBern Drive from Clague Road to Hawkins Road; WHEREAS, Chapter 305 of the Traffic Code provides for the maintenance of the traffic control file, which said file can be amended only by Ordinance. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Police Department be and the same is hereby authorized to amend the traffic control file of the City of North Olmsted to indicate thereon the removal of the "No Parking" signs on North side of LeBern Drive between Clague Road and Hawkins Road to now permit parking on LeBern Drive as aforesaid. SECTION 2: That the Mayor and he is hereby authorized and directed to cause said "No Parking" signs to be removed in accordance with the provisions of this Ordinance. SECTION 3: That this ordinance is hereby declared to by an emergency measure immediately necessary for the preservation of the public health, safety and welfare of the area residents and further reason that it is immediately necessary to remove the "No Parking" signs on the North side of LeBern Drive between Clague Road and Hawkins Road, in order to promote safety within this area of the City, and further, provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
