<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.94 - 163 <br />BY: Councilman Dean McKay <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO <br />MAKE EMERGENCY REPAIRS ON THE VACUUM FILTER SYSTEM AT THE <br />WASTEWATER TREATMENT PLANT, WITHOUT PUBLIC BIDDING, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, recent inspection by the City of North Olmsted of the Vacuum Filter <br />System at the Wastewater Treatment Plant has indicated that the system is in need of <br />immediate replacement and/or repair. <br />WHEREAS, the aforesaid problem has reached such a critical state that public bidding <br />and the time associated therewith would be too time consuming to meet the City's <br />obligation to protect the public health, safety and welfare, and <br />WHEREAS, upon the recommendation of the Director of Public Service, this Council <br />deems it an emergency sufficient in magnitude to forego public bidding on said project in <br />order to protect the public health, safety and welfare of the residents of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service, having obtained a quote for said <br />work, be and is hereby authorized to have the Marlin Mechanical Contractors, Inc. <br />perform the work consisting of permanent replacement and/or repair of the vacuum filter <br />system. In any event, the cost for said repair shall not exceed Thirty Thousand Dollars <br />($30,000.00). Upon approval by the Board of Control, the Mayor be and is hereby <br />authorized and directed to enter into a Contract for same. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is immediately necessary to protect the residents, and further <br />provided it receives the affirmative vote oftwo-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
