_........._...-.,u.... ~.... <br />~. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.94 -144 <br />BY: JANET SARINGER <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL EQUIPMENT <br />EASEMENT LOCATED ON PROPERTY OWNED BY COLUMBIA LAND <br />DEVELOPMENT COMPANY AND DESIGNATED AS PERMANENT PARCEL <br />N0.236-5-97-100 BY CUYAHOGA COUNTY MAPS AND RECORDS, SAID <br />EASEMENT SHOWN ON EXHIBIT "B", AND DECLARING AN EMERGENCY. <br />WHEREAS, Riser Foods, Inc. has agreed to pay all costs and expenses that are the <br />responsibility of the City of North Olmsted for the construction of the traffic signal <br />system and the loop detectors in their location within the new easement area shown on <br />the approved plans and as shown on Exhibit "B". <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts an easement from Columbia Land <br />Development Company for the traffic signal loop detectors, as shown on Exhibit "B". <br />SECTION 2: That the granting of the new easement and construction of the new Traffic <br />Signal System shall be accomplished at the sole cost and expense of Riser Foods, Inc. for <br />the costs and expenses that are the responsibility of the City of North Olmsted. <br />SECTION 3: That the Engineer of the City of North Olmsted is hereby directed to <br />cause said easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this Ordinance is hereby determined to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health and safety <br />of the City, and further provided it receives the affirmative vote oftwo-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />
