<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.94 -121 <br />BY: Councilman Dean McKay <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO <br />ENTER INTO A SUPPLEMENTARY CONTRACT WITH UNITED SURVEY, <br />INC. WITHOUT FURTHER BIDDING TO MAKE EMERGENCY REPAIRS ON <br />SEWER CONNECTIONS AT VARIOUS LOCATIONS INCLUDING BENTLEY <br />DRIVE, CURTIS DRIVE, DANBERRY DRIVE, OAK CIRCLE, OAK LANE, <br />PLUMWOOD DRIVE AND DECLARING AN EMERGENCY. <br />WHEREAS, recent dye testing by the City of North Olmsted of the sewer connections at <br />various locations including Bentley Drive, Curtis Drive, Danberry Drive, Oak Circle, Oak <br />Lane, and Plumwood Drive has revealed that various sewer connections are in need of <br />immediate replacement and/or repair, <br />WHEREAS, the aforesaid problem has reached such a critical state as revealed by recent <br />flooding that public bidding for this repair work and the time associated therewith would <br />be too time consuming to meet the City's obligation to protect the public health, safety <br />and welfare, <br />WHEREAS, the City has recently entered into a contract with United Survey, Inc. for <br />similar work as part of Phase F of the sewer rehabilitation program based on Bid <br />Resolution No. 94-26 through public bidding, in which United Survey Inc. submitted the <br />lowest and best bid, that said contract contains unit prices, and that United Survey Inc. <br />has agreed to utilize the Phase F unit prices for that supplementary contract, and <br />WHEREAS, upon the recommendation of the Director of Public Service, this Council <br />deems it an emergency sufficient in magnitude to forego further public bidding on said <br />project in order to protect the public health, safety and welfare of the residents of the <br />City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />
