ORDINANCE NO. 94- 61 <br />BY: Councilman Duane Limpert <br />AN ORDINANCE TO Ar~ID SECTI~T 911.99 ENTrI7~~ "PENALTY" OF CFIAFffit <br />911 FNrITL•ED "SEWERS (='FNERAi T Y" OF TBE CODIFIID ORDINANCF~ OF THE <br />CITY OF NORTH OIi~S~, OAIO <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga <br />County, Ohio, that: <br />SECTION l: Section 911.99 of the Codified Ordinances of the City of <br />North Olmsted, which now reads as follows: <br />"911.99 PENALTY <br />(a) Whoever violates any of the provisions of this chapter, <br />except Section 911.15, shall be served by the City with written notice <br />stating the nature of the violation and providing a reasonable time <br />limit for the satisfactory correction thereof. The offender shall, <br />within the period of time stated in such notice, permanently cease all <br />violations. <br />In addition, whoever violates any provision of this chapter or <br />Chapter 917 may be assessed or penalized in the amount of one thousand <br />Dollars ($1,000) per day for each violation. <br />(b) Whoever continues any violation beyond the time limit <br />provided for in subsection (a) hereof except as otherwise provided, is <br />guilty of a misdemeanor of the third degree for each violation. Each <br />day during which any such violation continues shall constitute a <br />separate offense. <br />(c) In addition to the foregoing penalty, whoever violates any <br />provision of this chapter shall become liable to the City for any <br />expense, loss or damage occasioned the City by reason of such violation. <br />(d) Whoever violates Section 911.15 is guilty of a misdemeanor of <br />the third degree." <br />BE AND THE SAME IS HEREBY AMENDID, AND AS AMENDED SHALL READ AS FOLLOWS: <br />
