i <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 94 - 57 <br />BY: Councilman Dean McKay <br />AN ORDINANCE TO A2~ID CHAPTER 901 EI~TrITLID "EXCAVATIONS" OF THE <br />CODIFIF~ ORDINANCES OF THE CITY OF OIIrS'1~, ~0 <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga County, <br />Ohio, that: <br />SECTION 1: Chapter 901 of the Codified Ordinances of the City of North Olmsted, <br />which now reads as follows: <br />"901.01 PERMIT REQUIRED; FEE AND APPLICATION. <br />No person shall make any opening in any street, boulevard, avenue or public <br />place in the City until such person has filed with the City Engineering Division <br />a written or printed application setting forth and indicating therein the <br />location, kind and extent of the pavement desired to be removed, and the number, <br />purpose and size of openings or excavations which are desired or necessary. The <br />applicant shall pay to the City the sum of Twenty-Five ($25.00) to the General <br />Fund before the permit is issued and shall deposit with the City an additional <br />amount sufficient to cover the cost of repairing or relaying and also the cost <br />of materials needed for repairing or relaying the tree lawn, roadway or paving <br />removed or damaged as a result of work done on or under the streets and public <br />rights of way of the City, plus Fifteen Percent (15%) for the cost of inspection <br />and general supervision, as shall be estimated by the Engineering Division of the <br />City. <br />901.02 ISSUANCE REQUIREMEI~]TS. <br />No such permit shall be issued until: <br />(a) The applicant shall have made the deposit referred to in Section 901.01. <br />Such permit shall state the exact time the opening or excavation is to <br />be made, the probable length of time for doing the work and the making <br />of the repair, the character of the pavement, including its base, and <br />the character of the work necessary for the satisfactory repairing or <br />relaying of the roadway. <br />(b) A policy or policies of liability or indemnity insurance issued by <br />companies licensed to do business in the State, recognizing the City as <br />an insured, in a total amount of not less than One Hundred Thousand <br />Dollars/ Three Hundred Thousand Dollars ($ 100,000/$300,000) for any <br />personal injury or injuries incurred and Fifty Thousand Dollars <br />($50,000) for any property damage caused as a result or consequence of <br />the making or existence of such opening or excavation, or the condition <br />of the road, street, sidewalk, tree lawn or other public property in <br />which the same is or has been made. <br />
