Boyle <br />T ' W` t~ <br />i t~~"' <br />,~ <br />AN ORDINANCE AUTHORIZING THE CITY OF NORTH <br />OLMSTED TO ABATE ITS CAUSE OF ACTION AGAINST <br />PATRICIA J. MARTIN AND JAMES A, BURNS, DIRECTOR <br />OF FINANCE, FOR THE ILLEGAL EXPENDTI'URE OF <br />FUNDS TO PATRICIA J. MARTIN. <br />WHEREAS, the State Audit Report for the period January 1, 1989 through December <br />31, 1990, has indicated that James A. Burns incorrectly paid Patricia J. Martin the sum of <br />$2,714.94 as accumulated sick leave for which she was not entitled, and <br />WHEREAS, the City of North Olmsted, under its power granted in Ohio Revised <br />Code section 117.28, has the authority to bring a civil action to collect this amount, if it so <br />desires, and <br />WHEREAS, due to the nature of the mistake involved, the years of service given to <br />the City by James A. Burns, and the equities of the situation, the City would like exercise its <br />statutory authority not to bring an action to collect these funds. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the City of North Olmsted abates its cause of action against <br />Patricia J. Martin, James A. Burns, and Mr. Burns's bonding company, for the illegal <br />expenditure of funds paid to Patricia J. Martin for accumulated sick leave in the amount of <br />$2,714.94, which was indicated in the State Audit Report for the period January 1, 1989, <br />through December 31, 1990. <br />_ .,, y.~ ~_..,... <br />
