..~ crrY of NORTH oL~rsz~D ORDINANCE NO. 94-12 RY: .MAYOR BOYLE AN ORDINANCE CRF,~TING NEW SECTION 509.YY OFTHE GENERAL OFFRNS,LS CODE OF ~'HL CITY OF NORTH O,L,tVISTED ENT177.~D "CREATING DISZTTRBANCES ON PUBLIC' Z"~?ANSPORTAT7ON, " ,A.S AMENDED, WHEREAS, this Council believes that i><adividuals who create dxstarbances while aboard public transportation create a greater threat to the health, safety and welfare of both the general public and City employees than individuals who create distu~ar~ces in other public areas; and WHERF„45, this Council desires to amend the City of North Olmsted's Ge>r~eral Offenses Code in order to criminalize such conduct of individuals who place the health, safety, and welfarre of the general public, as well as City employees, in danger while riding aboard public transportation; and WHL,REAS, this Council additionally desires to provide certain minimum mandatory suspe>~.sions from public transportation for individuals convicted of violating this vrdizaa~ace. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL 4F THE C'T,(x p,F NORTH OLMSTED, CUYAQ'OGA COUNTY, AND STATE OF O,~,iO: SECTION Y: That there is heareby created new Section 509.11 of the North Olmsted General Offenses Cade, entitled "Creating Disturbances on Public Transportation," which, as created, shall read as follows: 503.11 CREATING bISTURBANCES ON PUB.LxC TRANSPpRTA'Z'ZON (a) No person, while boarding on board, or exiting any form. of public transportation, shall recklessly cause meonvenience, annoyance, oar alarm to another by doing any of the following: (J.) Knowingly or recklessly causing or atteznptyrtg to cause physical harm to another; (2) Engaging in fighting, threatening harms to persons or property, ox engaging in viaXent turbulent behavior;
