,~~ <br />~:,;,. <br />Section 1. That the proposed rate of fees of one dollar ($1.00) per ton (three cubic <br />yards shall comprise one ton) adopted by the Policy Committee to be levied under Divisions <br />(A) and (B) of Section 3734.573 of the Revised Code upon the generation of solid wastes <br />within the District and disposed of within the State of Ohio are hereby approved. <br />Section 2. That the Clerk of this legislative authority is hereby authorized and directed <br />to mail or otherwise deliver promptly a certified copy of this resolution to the Policy <br />Committee. <br />Section 3. That this Council finds and determines that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were taken in an open <br />meeting of this Council and that all deliberations of this Council and of any committees that <br />resulted in those formal actions were in meetings open to the public in compliance with the <br />law. <br />Section 4. That this ordinance is declared to be an emergency measure necessary for <br />the immediate preservation of the public health, safety and welfare, and for the further reason <br />that the immediate effectiveness of this ordinance is required in order to permit the levying of <br />fees that are needed to finance the preparation and implementation of the Plan which is <br />necessary to permit the proper management of the disposal of solid wastes in the District and <br />this municipality, provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />~~ <br />Passed: /s ~f,~ <br />Attest: <br />l ~ ~ _ ~-~~...~ <br />BARBARA L.
