That the proposed rate of fees of one dollar ($1.00) per ton (three cubic yards shall comprise one ton) adopted by the Policy Committee to be levied under Divisions (A) and (B) of Section 3734.573 of the Revised Code upon the generation of solid wastes within the District and disposed of within the State of Ohio are hereby approved. Section 2. That the Clerk of this legislative authority is hereby authorized and directed to mail or otherwise deliver promptly a certified copy of this resolution to the Policy Committee. Section 3. That this Council finds and determines that all formal actions of this Council concerning and relating to the passage of this ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public in compliance with the law. Section 4. That this ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare, and for the further reason that the immediate effectiveness of this ordinance is required in order to permit the levying of fees that are needed to finance the preparation and implementation of the Plan which is necessary to permit the proper management of the disposal of solid wastes in the District and this municipality, provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor. ~~ Passed: /s ~f,~ Attest: l ~ ~ _ ~-~~...~ BARBARA L.
