+ , <br />~ Ordinance No . 9~+~ 1 Page 2 <br />S~LTION 3: Zhat the Municipality hereby agrees to participate with ODOT in the <br />cost of the improvements as follows: <br />1. That ODOT shall contribute Eighty Percent (80%) of the cost of construction <br />of the above described improvements and One Hundred Percent (100%) of <br />construction supervision and contract administration. <br />2. Within the corporate limits of the MUNICIPALITY, the MUNICIPALITY shall <br />contribute Twenty Percent (20%) of the cost of construction of the above <br />described improvements and One Hundred Percent (100%) of the cost of <br />engineering. <br />SECTION 4: That upon completion of said improvement, said MUNICIPALITY will <br />tt ei~rea~er keep said highway open to traffic at all times, and <br />1. Maintain the improvement in accordance with the provisions of the statutes <br />relating thereto and make ample financial provisions for such maintenance; <br />and <br />2. Maintain the right-of-way and keep it free of obstructions in a manner <br />satisfactory to ODOT and hold said right-of-way inviolate for public <br />highway purposes and permit no signs, posters, billboards, roadside stands <br />or other private installations within the right-of-way limits. <br />SF~(.TION 5: That the Mayor is further authorized to enter into any agreements <br />with ODOT as may be necessary and appropriate for the planning and construction of <br />this improvement in conjunction with the recommendations of the City Engineer, and <br />approved as to form by the City Law Director, in accordance with all authority <br />granted to and limitations upon by the City Director of Finance. <br />S~7CTION 6: That this Ordinance is hereby declared to be an emergency measure by <br />reason of the need to submit the application for consideration by NOACA and ODOT, <br />and provided it receives the affirmative vote of two-thirds of the members of <br />Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor; otherwise it shall take effect and be in force from and <br />after the earliest period allowed by law. <br />PASSED: y ~~~ <br />ATTEST: / ,~ <br />• T -- ~ C <br />war J.
