CITY OF NORTH OLMSTED <br />RESOLUTION N0.2010 - 4 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO A <br />MEMORANDUM OF UNDERSTANDING ("MOU') AGREEMENT <br />WITH THE CUYAHOGA COUNTY SOIL AND WATER <br />CONSERVATION DISTRICT ("SWCD") TO PROVIDE THE CITY <br />OF NORTH OLMSTED WITH MINIMUM CONTROL MEASURES 1 <br />& 2 IN ACCORDANCE WITH THE REQUIREMENTS OF <br />NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEMS <br />("NPDES') PHASE 77. <br />WHEREAS, acting pursuant to authority established by Ohio Revised Code <br />Chapter 1515, the SWCD proposes to enter an Agreement with the City of North <br />Olmsted, the terms and conditions of which are outlined in the attached MOU, to provide <br />for and fulfill NPDES Phase II Control Measures 1 & 2 on behalf of the City of North <br />Olmsted, in accordance requirements imposed by Ohio Administrative Code 3745-39-04 <br />(B)(1) through (6); and <br />WHEREAS, the MOU provides that SWCD will conduct, at a cost of $5,500, <br />Control Measures 1 & 2 for NPDES Phase II on behalf of the City of North Olmsted; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into <br />said MOU with the SWCD to provide for Control Measures 1 & 2 in accordance with <br />NPDES Phase II standards and to thereby promote the health, safety and welfare of the <br />City of North Olmsted; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: The Mayor be and he is hereby authorized to enter into a <br />Memorandum of Understanding Agreement on behalf of the City of North Olmsted, a <br />copy of which is attached hereto, with the Cuyahoga County Soil and Water <br />Conservation District, to provide the City with Control Measures 1 & 2 in accordance <br />with the requirements of the National Pollutant Discharge Elimination Systems Phase II. <br />SECTION 2: That this Resolution shall take effect and be in the force from and <br />after the earliest period permitted by law. <br />
