CITY OF NORTH OLMSTED ORDINANCE N0.2010 - 5 BY: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO ATWO-YEAR AGREEMENT WITH BOB'S ICE CREAM, INC., DBA QUALITY QUICK SNACKS, PROVIDING FOR VENDING AND VIDEO GAME MACHINES AT THE NORTH OLMSTED RECREATION CENTER, AND DECLARING AN EMERGENCY. WHEREAS, acting pursuant to the provisions of Section 111.01 of the North Olmsted Codified Ordinances, the Director of Community Life Services and the Recreation Commissioner solicited proposals on November 23, 2009, for a revenue generating contract for the purpose of the latter providing vending and video game machines at the North Olmsted Recreation Center; and WHEREAS, the Administration is satisfied with the quality of the services that have been provided to the North Olmsted Recreation Center by Quality Quick Snacks since 2004 and, following evaluation of their sole proposal under Section 111.01, recommended another extension of the two-year Agreement with the Board of Control, which in turn recommended same to Council on December 15, 2009; and WHEREAS, this Council has previously adopted Ordinance Nos. 2004-7, 2005- 150, and 2008-8, authorizing the Mayor to enter into Agreements with Bob's Ice Cream, Inc., dba Quality Quick Snacks [hereinafter, "Quality Quick Snacks"], for the purpose of providing vending and video game machines at the North Olmsted Recreation Center for consecutive two year periods from January 20, 2004, through January 23, 2010; and WHEREAS, it is the desire of this Council, based upon the recommendation of the Board of Control, to enter an Agreement with Quality Quick Snacks for an additional two-year period from January 24, 2010 through January 25, 2012; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into atwo- year Agreement with Bob's Ice Cream, Inc., d.b.a. Quality Quick Snacks, for the purpose of providing for Vending and Video Game Machines at the North Olmsted Recreation Center, for term of January 24, 2010 through January 25, 2012, in substantially the form and substance as the Agreement previously authorized by Ordinance No. 2004-7, and as _ renewed by Ordinance Nos. 2005-150 and 2008-8, a copy of which attached hereto.
