CITY OF NORTH OLMSTED <br />RESOLUTION N0.2010 -14 <br />By: Mayor Kennedy <br />A RESOL UTIDN A UTHORIZING AND DIRECTING THE DIRECTOR OF <br />PUBLIC SAFETY TO MAKE APPLICATION ON BEHALF OF THE CITY <br />OF NORTH OLMSTED FOR AN OHIO EPA STORM WATER <br />IMPROVEMENT FUND GRANT TO ELIMINATE EROSION WITHIN A <br />STORM CHANNEL ALONG WINDSOR DRIVE; FURTHER <br />AUTHORIZING THE MAYOR TO ACCEPT THE GRANT IF AWARDED; <br />AND TO EXECUTE A CONTRACT WITH THE OHIO EPA, AND <br />DECLARING AN EMER GENCY. <br />WHEREAS, the State of Ohio Environmental Protection Agency Storm Water <br />Improvement Fund is offering grants of up to $300,000.00 for the implementation of projects in <br />Cuyahoga County that, among other things, address storm water management and channel <br />erosion; and <br />WHEREAS, the grant, if awarded, requires no local match of funds; and <br />WHEREAS, the Director of Public Safety and Mayor Kennedy believe that these grant <br />funds should be utilized to rehabilitate an erosion damaged storm water channel along Windsor <br />Drive, all at no additional cost to the taxpayers of North Olmsted; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Director of <br />Public Safety to make application for said Ohio EPA Storm Water Improvement Fund for said <br />project, and to authorize the Mayor to accept the EPA grant if awarded; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby authorize the Director of Public Safety to <br />prepare, sign and submit an application for the State of Ohio Environmental Protection Agency <br />Storm Water Improvement Fund grant on behalf of the City of North Olmsted for the Windsor <br />Drive storm water channel rehabilitation in the maximum amount of $300,000.00; and does <br />authorize the Mayor to accept the grant and execute a contract and any and all other necessary <br />papers, if a grant is awarded. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that the City <br />may make a timely application for the EPA grant funds on or before February 15, 2010, and <br />further, provided it receives the affirmative vote of two-thirds of all members of the Council, it <br />shall take effect and be in force immediately upon its passage and apprpval by the Mayor. <br />
