CITY OF NORTH OLMSTED RESOLUTION N0.2010 -14 By: Mayor Kennedy A RESOL UTIDN A UTHORIZING AND DIRECTING THE DIRECTOR OF PUBLIC SAFETY TO MAKE APPLICATION ON BEHALF OF THE CITY OF NORTH OLMSTED FOR AN OHIO EPA STORM WATER IMPROVEMENT FUND GRANT TO ELIMINATE EROSION WITHIN A STORM CHANNEL ALONG WINDSOR DRIVE; FURTHER AUTHORIZING THE MAYOR TO ACCEPT THE GRANT IF AWARDED; AND TO EXECUTE A CONTRACT WITH THE OHIO EPA, AND DECLARING AN EMER GENCY. WHEREAS, the State of Ohio Environmental Protection Agency Storm Water Improvement Fund is offering grants of up to $300,000.00 for the implementation of projects in Cuyahoga County that, among other things, address storm water management and channel erosion; and WHEREAS, the grant, if awarded, requires no local match of funds; and WHEREAS, the Director of Public Safety and Mayor Kennedy believe that these grant funds should be utilized to rehabilitate an erosion damaged storm water channel along Windsor Drive, all at no additional cost to the taxpayers of North Olmsted; and WHEREAS, it is accordingly the desire of this Council to authorize the Director of Public Safety to make application for said Ohio EPA Storm Water Improvement Fund for said project, and to authorize the Mayor to accept the EPA grant if awarded; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That this Council does hereby authorize the Director of Public Safety to prepare, sign and submit an application for the State of Ohio Environmental Protection Agency Storm Water Improvement Fund grant on behalf of the City of North Olmsted for the Windsor Drive storm water channel rehabilitation in the maximum amount of $300,000.00; and does authorize the Mayor to accept the grant and execute a contract and any and all other necessary papers, if a grant is awarded. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety, and welfare, and for the further reason it is necessary that this legislation go into effect immediately in order that the City may make a timely application for the EPA grant funds on or before February 15, 2010, and further, provided it receives the affirmative vote of two-thirds of all members of the Council, it shall take effect and be in force immediately upon its passage and apprpval by the Mayor.
